Terms of Service

1. Acceptance of Terms

By accessing or using SwipeSights ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and SwipeSights.

2. Description of Service

SwipeSights is a web-based group trip planning application that allows users to discover attractions, vote on destinations with friends, and generate optimized travel itineraries. The Service includes both free and premium features. The Service is provided "as is" and may be updated, modified, or discontinued at any time with reasonable notice.

3. User Accounts

• You must provide a valid email address to create an account, or sign in via Google OAuth.
• You are responsible for maintaining the confidentiality and security of your account credentials.
• You must be at least 13 years old (or the minimum age required by applicable law) to use SwipeSights.
• One person may not maintain more than one account.
• You are responsible for all activity that occurs under your account.

4. Premium Credits and Payments

4.1 Premium Credits

SwipeSights offers premium features that can be unlocked by purchasing premium credits. Credits are one-time purchases that do not expire. Each credit can be applied to upgrade one trip to premium status. When one group member upgrades a trip, all members of that trip receive access to premium features for that trip.

4.2 Pricing and Packs

Premium credits are available as a single credit or a 3-credit pack at a discounted rate. All prices are displayed in the currency and inclusive of taxes as determined by our payment provider. Prices may change at any time, but changes will not affect previously purchased credits.

4.3 Payment Processing

All payments are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all transactions. Paddle handles billing, payment security, sales tax, and invoicing on our behalf. By making a purchase, you also agree to Paddle's Terms of Service.

4.4 Refunds

Refunds are available for unused premium credits. If you have used some credits from a multi-credit pack, you will be refunded only for the unused portion at the individual credit price. For full details, please see our Refund Policy.

5. Free and Premium Features

The free tier includes:

• Trip planning for up to 3 days
• Groups of up to 3 members
• Attraction voting and itinerary generation
• Attraction ticket booking links
• Calendar export

Premium features (per-trip upgrade) include:

• Trips up to 10 days
• Groups up to 20 members
• Interactive route maps with numbered pins
• Vote review analytics
• PDF export with photos and timelines
• Day and attraction rearranging
• Nearby sights suggestions
• More attraction cards to swipe
• Unlimited itinerary regeneration
• Smart restaurant suggestions

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any part of the Service, its servers, or its databases.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Scrape, crawl, or use automated means to access or extract data from the Service without written permission.
• Create accounts using automated methods or maintain multiple accounts.
• Impersonate another person or misrepresent your affiliation with any entity.
• Upload or transmit viruses, malware, or any other harmful code.
• Attempt to bypass premium feature restrictions or manipulate the credit system.

7. Itinerary and Travel Information

Itineraries generated by SwipeSights are algorithmic suggestions based on route optimization, AI-estimated visit durations, and publicly available data from Google Places. We do not guarantee the accuracy of opening hours, travel times, attraction availability, pricing, or any other information. Always verify details independently before your trip. SwipeSights is not a travel agency and does not book accommodations or transport on your behalf. Ticket booking links redirect you to third-party providers (such as GetYourGuide) where you complete any purchase directly with them under their own terms.

8. Third-Party Links and Affiliate Disclosure

SwipeSights contains links to third-party websites and services, including Google Maps (for restaurant locations and directions), GetYourGuide (for attraction tickets and skip-the-line passes), and Viator (for tours and experiences).

Affiliate Disclosure: Some links on SwipeSights are affiliate links. If you click through and make a purchase on a partner site (such as GetYourGuide or Viator), we may earn a small commission at no additional cost to you. This helps support the development of SwipeSights.

We are not responsible for the content, privacy practices, or services provided by third-party websites. Your interactions with third-party services are governed by their own terms and policies.

9. Restaurant Recommendations

Restaurant suggestions displayed during meal breaks are sourced from the Google Places API and ranked by user ratings and proximity. These are not paid placements, sponsored recommendations, or advertisements. SwipeSights does not receive compensation from individual restaurants for their inclusion in itineraries.

10. Intellectual Property

The SwipeSights name, logo, visual design, source code, and application architecture are the property of SwipeSights and are protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works based on the Service without written permission.

Your trip data, votes, and content you create within the Service remain yours. By using the Service, you grant us a limited license to process and display your content as necessary to provide the Service to you and your trip group members.

11. Limitation of Liability

To the maximum extent permitted by applicable law, SwipeSights is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall SwipeSights, its operators, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: travel disruptions, missed attractions, inaccurate information, data loss, loss of profits, or any damages arising from your use of or inability to use the Service. Your sole remedy is to discontinue use of the Service.

12. Indemnification

You agree to indemnify and hold harmless SwipeSights, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Account Termination

You may delete your account at any time from the Settings page. Upon deletion, all your personal data, trip data, and votes will be permanently removed from our servers.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or attempt to exploit the Service. In cases of account termination for Terms violations, unused premium credits may be forfeited.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration or in the courts of the applicable jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

16. Changes to Terms

We may update these Terms of Service from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of SwipeSights after changes constitutes acceptance of the updated Terms. If you disagree with the changes, you should discontinue use of the Service.
